REPRESENTATIVE MATTERS

    • For Collectors: Retained by major New York collector to manage art-related issues in a divorce action.  Actions and oversight resulted in client’s retaining approximately substantially all of an important collection; coordinated actions of all counsel concerning art.  Retained by collector and major art consultant to create a discrete business organization for jointly dealing in contemporary art.  Retained by collector to assist in the creation and development of a new company for consulting, production of fine art multiples, and other art-oriented ventures. Retained by international collector in dispute with New York gallery over delivery of artwork.

    • For Galleries: Retained by New York gallery in litigation with artist who in bad faith attempted to undo sales made on artist’s behalf and to withhold payment of commissions. Advised and represented international gallery in collection of significant unpaid debt owed to gallery by a collector.  Advised New York galleries in the negotiation of key points in an exhibition and consignment agreement for artists’ works at other galleries. Advised New York and international gallery concerning contract, general corporate, insurance and litigation matters.

    • For Artists: Counseled an international photographer with copyright issues arising within the context of a large conceptual art project.  Drafted unusual confidentiality agreements for an international artist as part of his larger performance, video and sculptural work.  Recovered artwork wrongfully retained by European gallery. Recovered artwork and payment wrongfully retained by New York dealer. Counseled international artist in threatened litigation by European gallery, matter resolved in artist’s favor.

    • For Art-Related Businesses: Drafted employment, confidentiality, non-solicitation and separation agreements for an art shipping and storage business.  Negotiated all agreements for a $5 million company in its sale of a minority stake to a group of outside investors.  Resolved contract disputes and collection matters.  Drafted engagement and arbitration agreements for art consultants and advisors.

    • For Not-for-profits: Advised an established contemporary art museum concerning legal issues raised by content of a new media exhibition.  Advised and negotiated production and exhibition agreements for a not-for-profit arts organization that produced a major multi-media performance piece that premiered at Art Basel/Miami Beach and later exhibited at the Whitney Biennial, the Walker Art Center, and international venues.

    • General Litigation: Represented California client in highly-contested litigation to collect compensation owed as part of a class action settlement and a related receivership action, with a gross recovery of more than $500,000 to the client.  Represented another California client in mediation to resolve a payment dispute with a Fortune 100 company, resulting in an additional $200,000 for the client.
